Important:
Fine art photography sold by The Light & Eye, including limited-edition prints, constitutes copyrighted artwork. The purchase of a print does not transfer copyright or grant any reproduction, display, distribution, or derivative rights in the underlying image.

SECTION 2 – PERMITTED PERSONAL USE

You may:

View the website and Content for personal, non-commercial purposes; and
Share public links to our pages via social media platforms without downloading or modifying the Content.

You may not:

Include our Content in datasets used to develop generative or predictive models;
Use our Content for image-to-image generation, style transfer, or similar automated synthesis.

The unauthorized ingestion or use of our copyrighted images for AI training or generative outputs constitutes infringement under applicable U.S. copyright law.

SECTION 5 – PRINT PURCHASES

The purchase of a physical print (including limited editions) grants ownership of the physical object only.

No purchaser may:

Reproduce the image in any format;
Scan, digitize, or otherwise create copies of the work;
Use the image for promotional or commercial purposes;
Display the work publicly for commercial gain without written license.

All reproduction and commercial display rights remain exclusively with The Light & Eye LLC.

SECTION 6 – DIGITAL LICENSING

Digital licenses may be granted for:

Editorial use
Commercial campaigns
Hospitality installations
Exhibition or institutional display
Digital display systems or devices

No rights are granted unless and until a written license agreement is executed.

Use of any Content beyond the scope of a granted license—including duration, territory, media, or audience—constitutes unauthorized use.

Unauthorized use may result in:

Immediate termination of license
Retroactive licensing fees
Legal enforcement under applicable copyright statutes

SECTION 7 – REPORTING INFRINGEMENT (DMCA NOTICE)

The Light & Eye actively monitors and enforces its intellectual property rights.

Statutory damages (up to $150,000 per work for willful infringement);
Injunctive relief;
Recovery of profits;
Recovery of legal fees where permitted.

We reserve the right to seek retroactive license fees for unauthorized use.

This Policy shall be governed by and construed in accordance with the laws of the State of New York and the United States of America.

Any disputes shall be subject to the exclusive jurisdiction of the state or federal courts located in New York, New York.
